Mr. Caplan is a practicing litigator since 1982 trying a wide variety of cases including   disputes involving contracts, real estate, trade secret, business/shareholder issues, insurance, Deceptive Trade Practices Act, construction, employment, business torts, banking, premises liability and securities.  He has also handled and tries tort disputes.  Mr. Caplan practices before all Texas state and federal courts and has also argued before the Court of Appeals for the Federal Circuit in Washington, D.C.  While Mr. Caplan has focused his practice primarily in Texas, he has tried jury and non-jury cases in many other jurisdictions for his representative clients.

Mr. Caplan has successfully tried a great number of cases to verdict, both jury and non-jury, from both the plaintiff as well as the defense side of the table.  He has also represented clients in arbitrations to successful verdict as well. He has continuously practiced as a trial lawyer since he was licensed.

Mr. Caplan is also a licensed mediator.   His many years of varied litigation experience have assisted him in finding creative solutions to cases that "extend the envelope" and he has been praised by his peers for his tenacity in finding solutions to difficult disputes of all types.

Obtained a jury verdict of 17.5 million dollars in a trade secret/breach of secrecy agreement case

Obtained a 1.5 million dollar verdict in favor of firm’s client in a shareholder oppression suit

Obtained several successful federal court verdicts in litigation under the Federal Communications Commission for national client

Successfully defended real estate owner against tenant in jury trial for breach of construction contract and fraud allegations. Take nothing judgment awarded by jury

Obtained a successful defense verdict for a publicly traded company in a breach of contract action.  Received a take nothing jury verdict

Obtained a successful defense arbitration award regarding a breach of contract dispute between commercial real estate developers involving popular Houston dining establishment. Take nothing award by arbitrator

Successfully defended challenge to inventorship of U.S. Patents, argued and affirmed by U.S. Court of Appeals for the Federal Circuit.
